Exporting model to 3ds with applyed mirror modifier

Hi, I have a a model that I import as a 3ds file. I need it to be symmetric on the y axis. so I add a mirror modifier, hit apply and then export it as 3ds. I get the error: “Object %r can’t be written into a 3DS file”
Why is this not working?
