Using someone’s likeness in a game is not illegal, it’s done all the time. legally, tho, if you don’t get permission then they can sue you for using their likeness without their consent. If you are profiting from said game then they can sue you for cash. If you are defaming them they might be able to get you arrested for defamation. However, parody is legal and you CAN get away with using someone’s likeness for parody. The guy that made that Jack Thompson game proved that.
Either way, Get Chuck Norris’ permission, for cryin’ out loud. Do you have a death wish or something?
Seriously, i think there are already a few fan-made flash games out there. He seems to be pretty cool about that sort of thing. You can’t sell the game tho, or profit off it. That may also mean ad revenue. For commercial games you have to get permission or he’d sue you to the stone-age and then kick you back to the present.
