even the name “magix” is a protected trademark and since that company has an own 3d package to sell, they might be interested in this, too. i dropped them a mail.

Technically…

the use of the blender logo in the screeshots violates this:

and the use of artists’ work without permission of each individual artist is a violation.

though… I see Disney showcasing some of Pixar’s earliest films; even though they didn’t own Pixar at the time the films were created.
This concept does not carry through, unless “Cody Landon” owns the blender foundation…

I have not seen the license for the 3Dmagix… so I do not know if he broke the rules in that regard as well…

It’s a different discussion really, but as far as I know Disney have been partnered with Pixar Since before Toy Story, with Disney in charge of marketing and distributiom. Infact Toy Story was pitched to disney execs in order to get the green light on the project. Also John Lasseter, one of the founders of Pixar is now in a high up position in Disney so it’s likely that he would be happy for Disney to showcase PIxar’s stuff. It’s entirely likely that there is a clause in their contract stating that Disney has the right to showcase all of Pixar’s works, past and present.

This kind of stuff makes me furious! It’s clearly a scam. The GUI looks exactly like blender’s GUI. On top of that, all the images on his website were created by individual artist (many of which come from this very forum)! It’s also a slap in the face to all devs that work hard to make the real blender possible.

I think that this is the saddest thing. That the guy pretends to earn huge(!) amount of money thanks to very hard work of many coders by not even touching it at all. And claiming that he did it by himself.

however you can complain about someone ripping your pictures -copyright laws in most countries US&UK included agree that an image has copyright status as soon as it’s published.

GPL is a document with all the best intentions to save the world :-). but the point of a license is to put a foot down. To make matters worse Blender is a mountain of legal woe as the software aims to be the swiss army knife of 3d content.
Studios and users need to be assured some security; that a code crippling court order will never be handed down - leaving us with some piece of half baked software that once was!
I believe the commercial and open source world can co-exist smoothly (ie Joomla!), but the very grey nature of the words ‘commercial’ and ‘Blender’ puts off most commercial projects. The blender foundation needs to take a stance and give its opinion in a clear manner. There’s more than just programming that needs to be done (hinting at 2.5).

And he violates the copyright anyway with all the hosted images. Too bad that there is no Cloth - Image or video made by me otherwise his provider would have gotten an eMail and my I would also take some legal advice how to enforce the copyright on my material.

But as I said, no Cloth as far as I can see - so I cannot do anything :frowning:

of course you can file in a notice to his provider.
there is plenty of your intellectual property inside blender. and afaik everyone who has contributed anything to blender, and be it just a single line of code, can take steps against such a copyright infringement. after all if he claims that he has written the software, he also claims that he has written your cloth code. and another clear violation is, that he obviously doesn’t release the source code of “his” software.

he clearly violates the gpl by stating that he has written the software.
and as mentioned on the blender.org site, he may not even claim that all those pictures and movies were made using “3dmagix”. if you decide to sell blender as another software under another name you are absolutely not allowed to use blender reference material anymore.

i just received a mail from the hoster of this guy. they said that they just contacted the blender foundation, asking them if they will make a formal complaint and if they can confirm the claims about the copyright infringement i made in my first mail to the hoster.
